Modern dilemma: Sofia Vergara's ex is suing her to get access to her embryos.

Actress Sofia Vergara‘s ex-fiancé, Nick Loeb, has filed a lawsuit to prevent her from destroying embryos the couple created together through IVF.

The two embryos, both female, were created in November 2013 (six months before the couple split) using his sperm and her eggs.

The reports are based on court documents obtained by In Touch, which also include worrying claims that the 42-year-old Modern Family star was “was physically and mentally abusive” to Loeb, 39, on numerous occasions.

“She punched him in the face on two occasions, kicked him, and threw her phone at his head. She also routinely bullied him, calling him a ‘loser,’ ‘worthless’ and other degrading names,” the papers say.

Something more light-hearted:

The couple had apparently planned to use a surrogate to have children and had made two previous failed attempts to have embryos implanted.

It is unclear what Loeb intends to do with the embyros, but he is strongly pro-life, according to the report.

In 2013, the couple got into a heated argument in a California-based fertility clinic over what would happen to the embryos if they died.

Vergara — who has a 22-year-old son from a previous marriage — insisted that they be thawed.

She is currently engaged to True Blood star Joe Manganiello, with the couple announcing their engagement in December.
