A man posing as an Uber driving has allegedly raped a British tourist who was sleeping in the back of his car after a night out in Sydney.

Fairfax reports that the 22-year-old woman had been out with friends in King’s Cross when Muhammed Naveed pulled up beside her and offered her a lift early on Sunday morning.

He then drove her to a nearby side street where is accused of sexually assaulting her while she slept.

Before the attack, CCTV captured footage of Mr Naveed stopping at a service station, where he bought condoms and a bottle of water.

The woman, who has only been in Australia for three weeks, says she was highly intoxicated and was confused when he allegedly told her, “Hey baby I’ve got some condoms”, before asking her if she wanted to move the back seat.

She did so, thinking it was because she was falling asleep, but woke up to him having sex with her.

She tried to stop him, but he continued.

Mr Naveed, is married and a permanent resident of Australia, he insisted that the sex was consensual when he appeared in court on Thursday.

He has been charged with sexual intercourse without consent and remains in custody with his bail set at $5000.

Police have seized his car and Uber is aiding them with their ongoing investigation into the incident.

“Our thoughts remain with the victim and her family in this terrible situation,” a spokesperson for the company said.

“We will do everything we can to work with the police to help with their investigation.”

Mr Naveed will return to court in December.
