Student jailed for raping man by using fake Facebook profile in sex hoax.

By Elizabeth Byrne

A university student convicted of raping a man using a false female Facebook account to trick his victim into having sex with him has been jailed for almost five years.

Billy Tamawiwy, 23, was found guilty of six charges in the ACT Supreme Court in September.

The charges included two counts of rape, three counts of using a carriage service to menace and one for committing an act of indecency.

The Indonesian student had already pleaded guilty to several charges related to sending offensive material.

The court heard Tamawiwy set up the Facebook account using a picture of a red-headed woman he found on Google.

He then used the fake account to approach several young men, introducing the subject of sex and suggesting bi-sexual sex.

He was charged after a complaint from a man who said he was tricked into having sex with him, on the promise of sex with the woman on the Facebook account and two of her friends.

A key issue in the case was whether Tamawiwy had misled the man, and consent to the sex was negated.

Tamawiwy was arrested after the rape victim went to police when Tamawiwy sent images of the encounter to the man’s younger brother.

Others targeted by Tamawiwy told the court he had threatened them through the false account when they stopped responding to messages.

Justice Richard Refshauge told the court the behaviour was entirely unacceptable.

Tamawiwy was sentenced to four years and 10 months in jail.

He will be eligible for parole in November 2016, but the court heard he was likely to be deported once free.
