Rape case against Hilary Duff's ex-husband, Mike Comrie, has been dropped.

The rape case against former professional hockey player, and the ex-husband of Hilary Duff, Mike Comrie, has been dropped.

Mike – who was married to the Lizzie Maguire actress and singer for five years before they split in 2015 – was accused of sexual assault in February.

TMZ reports the 36-year-old father-of-one was being investigated over an incident involving two women at his Los Angeles home in February.

One of the women accused the star of sexual assault after he refused to stop during a sex act that she had not consented to.

A spokesperson for the LA County District Attorney's office has now confirmed to E! News that the case has been dropped due to insufficient evidence.

Prosecutors said there was reasonable doubt as to whether the accuser had consented to anal sex during the alleged encounter with Mike Comrie earlier this year.

Hilary Duff did not comment on the accusations against her ex at the time, and has yet to comment on news the charges against him have been dropped.

The pair has been close since announcing their separation in 2014, with Hilary and Mike spotted out in public in the months following the allegations.

They have a son together, five-year-old Luca.
