'Stop wearing your daughter's pyjamas,' says judge.

“Your child is not a joke”

Bethenny Frankel, 43, posted a picture of herself on Instagram in July. It was an image of Frankel wearing her four year old daughter’s Hello Kitty pyjamas. “This is my daughter’s nightgown and PJ shorts. Think we’re ready to start sharing clothes yet?” Frankel wrote in the post.

It has been scrutinised. Laughed at. Oh, and nicknamed #pyjamagate. But, this time, it’s a Supreme Court Judge who has given Frankel a dressing down about the image.

Frankel, reality tv star and the founder of Skinny Girl Cocktails, is currently undergoing lengthy divorce proceedings against her husband. In court, the image was brought before Manhattan Supreme Court Justice Ellen Gesmer who told Frankel she had to “grow up.”  And “no more [kids] pyjamas”. When Frankel’s lawyer told her it was just a joke, Justice Gesmer said, “It’s not a joke. Her child is not a joke.”

The judge’s view was that once a photo is uploaded to the internet it is no longer yours. It belongs to everyone who can download, edit, copy, paste and scrutinise it. Bryn, Grankel’s four year old daughter, will find this image in years to come. She might be bullied for it, teased relentlessly. By that time, her daughter won’t be able to do a thing about the picture.

Frankel had this to say about the matter: “The truth of the matter is I don’t really care what people think if I don’t think I’ve done anything wrong. It was a dress of my daughter’s and she’s like put this on and one of my friends was like, ‘Your Instagram game is weak.’ So I just took a picture and thought it was cute. I had no idea that I would get that backlash. I had no idea and I really didn’t think it was that big of a deal. I just thought it was a ridiculous joke. I peed in a champagne bucket at my own wedding.”
