The Australian Communications and Media Authority has found radio presenter Kyle Sandilands breached radio code of practice last year when he labelled News Limited journalist Alison Stephenson a “piece of shit” following her negative report of his TV show, A Night with the Stars.

The media authority found the comments he made were derogatory and said steps were being taken to impose new licence conditions on Sandliland’s employer, 2Day FM.

News.com.au reported:

“The Authority found the comments by Mr Sandilands deeply derogatory and offensive and in all the circumstances a licence condition is the appropriate response,” said ACMA chairman Chris Chapman.

In its findings, ACMA said the remarks breached the Commercial Radio Codes of Practice 2011.

But Mr Chapman said the ACMA found the comments did not breach the code prohibition on inciting serious contempt or severe ridicule on the grounds of gender.

“Although the comments conveyed hatred, serious contempt and severe ridicule on the grounds of gender, they were not considered likely to incite those feelings in others,” he said.

“From now on Sandilands will be prevented from broadcasting any material that is likely to demean women or girls or face a loss of licence,” The Sydney Morning Herald reported.

In January, ACMA announced it would investigate Sandilands’ conduct – saying it was acting on complaints about the radio host.

Late last year,  Sandilands sparked controversy when he said of News Limited journalist Alison Stephenson:

“You’re a piece of shit. This low thing, Alison Stephenson, deputy editor of news.com.au online. You’re supposed to be impartial, you little troll…. You’re a bullshit artist, girl. You should be fired from your job… Watch your mouth or I’ll hunt you down.” He also called Ms Stephenson a “fat bitter thing” and attacked her hairstyle and breast size.

Following his comments, an online petition was launched pressuring sponsors of Kyle’s radio show to pull their support.

At the time, the organiser of the petition Emily Hehir wrote for Mamamia about what she was doing. Here’s what she had to say:

We must make it clear to companies who promote and associate with these archaic attitudes that we won’t stand for it. This week I joined with over 26,000 others, calling on advertisers to boycott the Kyle and Jackie O show as long as it provided a platform for bullying, abuse and misogyny. The extraordinary public reaction to the petition I created – and the ensuing exodus of advertisers – shows that it will be harder and harder for brands to get away with perpetuating the lowest common denominator.

We must also start conversations that promote the infinite ways of being a “success” – and there are so many ways to create and promote these authentic narratives that don’t rely on stereotypes. We can start by encouraging compassion: towards ourselves and each other. We are so indoctrinated into criticising women that it is almost subconscious. Foster the beauty of diversity, nuance and imperfection in whatever way you can. The more it is honoured the more legitimacy it will have in our society.

We must also challenge the mainstream media to do better. Show us women who are courageous or smart, and not just as the subplot to their physical beauty. We have a responsibility to demand more from the media – if not for ourselves then for the younger women watching and listening – and challenge the attitudes that underpin the content on our airwaves. Attitudes that lead to a man thinking it is legitimate to pass judgment on national radio on the worth of a woman’s opinion based on her ‘titty’.

After the petition, Mazda, Telstra, Crazy John’s, Harvey Norman, Holden, retail giant The Good Guys, Blackmores, Fantastic Furniture, Vodafone and Medibank pulled their sponsorship.

His comments are now believed to have cost his employer, Southern Cross Austereo, up to $10milion in sponsorship.

Kyle later apologised for his actions. In an open letter, he said:

“I took my remarks too far and for that – and the offence caused to [journalist] Alison Stephenson and those exposed to my comments – I sincerely apologise,” he said.

“I regret the impact this has had on our clients and our hard-working staff, who have had to weather a storm of criticism in the media and on social networks.”

    majority of today fms demographic are loyal to kyle because they can relate on a personal level. he’s witty funny and not afraid to tell it how it is. I think the pedantic need to ease up and understand he did step out of line but he is human and makes mistakes like you.

    kyle has been just as offensive to men in the past, read his comments toward Dave Hughes and Molly Meldrum to mention just 2. Yet it is only when he does the same to women that it results in an inquiry. And the result of this inquiry only states that he cant say anyhing derogatory or offensive about women or girls.

    So what, it is open slather on any male he sets his sights on is it.

    This whole one sided gender stuff is getting ridiculous. Females, the great untouchables. How about equal respect for all. Isnt that afterall the definition of equality.

      Firstly, Sandilands is a complete and utter tool. Secondly, yeah fair call, equality is equality, if he’s saying these offensive things about men also, the outcry should be about his behaviour towards everyone he publicly insults, not just women. But before you get your knickers in a twist crying “Oh females the great untouchables” please try to remember, women have HAD to fight for the same rights, have HAD to fight to be taken seriously for our minds not our looks in a male dominated world and still do. So maybe cut us some slack if sometimes we can be occasionally oversensitive.
      Thirdly, Sandilands is SUCH an obvious attention seeking tool, it boggles me why anyone listens to him or cares what he says.

    Another reason why self-regulation is failing and ACMA deserves its name as the toothless tiger. Mind you, the backlash due to people like Emily Hehir hopefully means people the likes of Kyle will actually think before they speak or at the very least, their producer will hit that delay button.

    If only we might actually get a government one day who will have the guts to actually run with some terrific reform proposals recently eg. Gonksi, Fink and whats left of the Henry review.

      If so, Stephen Conroy’s your man. He wants to censor all and everything that doesn’t agree with the Labor left wing agenda. Gonski and Finkelstein are merely servants in the grand plan to control Australia’s media.

    I don’t listen to any commercial radio station, but I will be glad when this man is taken off the radio.. Imagine all those teenagers and young adults who listen to him daily and think that this kind of behaviour is normal and acceptable.

    I do not listen to Karl Sandilands but then I am not in the demographic being targetted by that show. He is a bully a showoff and a creep. If this is all an act for ratings (as I have read that he is a nice person!!??)then that makes him worse, why? because the young market he is aiming for are what, 14 – 19 year olds? And what a sleazy obnoxious example he sets. Jackie O has sullied her image for laughing along with his tirades but perhaps she is intimidated by this bully as many people seem to be. At the end of the day, people vote by turning off. The owners of the radio station should be ashamed of themselves for supporting him. Understand why, Money! Shame on them. The advertisers should set an example to the community by voting with their dollars and moving on. There is a lot of decent talent around for them to support. Although they lost some advertisers most have stayed with the show…. Money again! Shame on them.

    When I hear kyle’s voice on the radio I immediately switch. If you don’t like him then don’t listen. Unfortunately being upset by his comments will only have a negative effect on you but choosing not to listen to him will have more of an impact than any comments you’ve expressed here.

    I won’t listen to either the show or the station that employs Kyle. I usually have my young daughter in the car and would not want her exposed to this kind of offensive, hate-filled talk. I don’t want to subject myself to it either. It is a shame so many people have been raised to think it is OK to speak that way, to think derogatory and threatening speech towards women is funny.

    I’d also like to choose a radio station that does not play Chris Brown, sadly haven’t found one yet.

    I think that this post reeks of double standards:(

    Hark back to the post about Yumi Stynes (Wednesday 7th March) where the big cry was that Yumi said that she was sorry for calling a war hero a “dud root”, so now everyone should forgive her.

    Kyle Sanderilands has also said that he was sorry, so why isn’t this post preaching forgiveness for Kyle?

    Is the big difference that Yumi who is female was slagging off a male, whereas Kyle is a male who is slagging off at a female?

      No, the difference is that Yumi did it once and immediately apologised, and hasn’t done it again, which implies she made a genuine mistake and is genuinely sorry and desires to change her behaviour.

      Kyle does it again and again and again. It seems like his misogyny is so ingrained he either doesn’t realise or doesn’t care when he’s being offensive. Or he wants to be offensive to get ratings up. That’s the difference.

      I don’t choose to listen, but even I know the things Kyle comes out with. I consider myself pretty unshockable, but what he said about the female journalist was appalling. I do wonder if that’s the role he’s been asked to do (so to speak) by management, or if he’s like that naturally.

    And no-one has mentioned that Channel 7 is still backing him, with the promotions for the new series of Australia’s Got Talent still liberally featuring him! So really for him there have been no real consequences… everyone’s still employing him, listeners still listening. The employers are taking a hit on ad revenue which must be having a knock on effect on others at the station, but he really hasn’t been held to account at all.

    Lplates, I don’t think it is intellectual snobbery. Most of us are saying we don’t appreciate derogatory comments made by anyone. Irrespective of whether it was directed at a male or female, no one should slander another person like he did. There are other ways to make comment on your dislike for what she said, that doesn’t include reference to physical appearances. I am happy that it did get a lot of attention and that we do discuss it.

    Personally, Kyle Sandilands disgusts me. I can’t stand anything about him, nor do I understand the willingness of TV and radio networks to thrust vast sums of money at him to air his opinions. On the other hand….I can understand why some might find his “talent” enjoyable and clever.

    Horses for courses, sweets for the sweet. Love him or loathe him. I choose to dislike the individual most strongly. The less that I hear about this person the better I like it.

        It is hard ball in the media industry. Any recognised personality going up against Kyle knows very well what they are in for. Alison Stephenson was playing with fire.

        Yes, she is entitled to her own opinion but in some circumstances it is better to keep your own words to yourself. And in this instance she should have known better.

        I personally still buy ad space with 2Day FM because they rake in the 2m listeners a day… Thanks to Kyle.

          It would be almost worth listening to the show in order to create a list of sponsors to boycott and encourage the millions who despise Kyle’s views to do the same.

          Actually, Alison Stephenson didn’t ‘criticise’ Kyle. She reported on the fact that viewer numbers of his TV show were decreasing. So basically, he went off the deep end and threatened her for reporting the truth. She wasn’t expressing her opinion, she was stating the facts about his ratings. Why should she have kept that to herself? It’s her job to report on these things.

There needed to be much wider spread advertising drop out and listeners cutting off from the show to get him sacked, and that is sad… it was a huge effort by regular people everywhere that got nowheere and he still graces the airwaves making the big $$$.

    What is really needed is education and rehabilitation for the forgotten underclass of Australians that actually listen to and enjoy the Kyle and Jackie O Show. We can help them to rise above their putrid, snivelling existence, show them that the off switch is a powerful tool that they can use to escape the intellectual and emotional poverty that they are exposed to day after day. If there are no listeners there is no show… if there are less morons there are less listeners.

    It’s not enough. The ACMA admitted they can’t do anything about Kyle personally, they can only go after the radio station, so they have this high-level restriction on the radio station that is so ambiguous and open to (mis)interpretation that it is going to create an unnecessary culture of people being afraid to say anything for fear of offending someone, while the people who need to be restricted are allowed to continue broadcasting. As long as there is a demographic of people who enjoy Kyle’s crass style of broadcasting 2DayFM will keep him on the air, which at the end of the day means the ACMA’s ruling has achieved exactly nothing.

    Imagine if his rant was an email that made its way around any office in the country. He would be sacked. Plain & simple.
    Why is it that he can say such deplorable, offensive and abusive things on national radio and still keep his job? He is nothing more than a bully, and yet he still has a national platform? THAT saddens me the most.
    I’m pleased that ACMA has reached a decision, personally, I don’t think it goes far enough.

        I agree with all you said.
        I work in a male dominated workplace. I am treated with respect. I would not put up with hearing those sort of comments from anyone without lodging a complaint. I have had blokes try to intimidate me physically. It’s just not on.

    I get so confused about ratings – I thought I read in a Jackie O story the other day that ratings to the show fell in February, but bounced back this month?

      Ratings change from week to week, month to month, depending on how many people watch or listen to tv shows/radio.

      For instance, if I started listening to the Kyle and Jackie O show (which I haven’t done for nearly 2 years) then the ratings would probably improve if there are other people out there like this.

      The worrying thing is though, the more exposure both of them get (good or bad articles) the more likely people are to flick over to the station to see what the fuss is all about….

    Ratings drop on the Kyle and Jackie O show, deceny codes flouted and producer Bruno kept on despite a disgusting racist blog that also jokes about wife bashing.
    The show is dead.
    Advertisers have and will continue to run a mile from them.
    The universe is rewarding the pair of them for their years of degrading, sleazy radio.
