After 5 years, a scientology marriage ceremony, a daughter born during a silent birth, endless chatter about their age difference, countless red carpet appearances and a declaration of love, live on Oprah – Tom Cruise and Katie Holmes are splitting.

Once you have a standalone ‘couple name’ ala Brad and Angelina, then there really is no question that you’ve made it in Hollywood. And yesterday brought the news that ‘Tomkat’ is no more.

The split had everyone talking about the future custody arrangements for their daughter Suri and whether Katie would break with the Church of Scientology. But today the media circus moves on… to the pre-nup.

The Courier Mail reports:

The details? For each year the couple stay married, the Dawson’s Creek actress collects $3 million – to a maximum of $33 million after 11 years – as well as their palatial home in California.

Then, if their marriage had lasted more than 11 years, Holmes would have received half of Cruise’s reportedly $250 million fortune.

After filing for divorce less than six years later, according to the agreement, Holmes should only be entitled to $15 million as well as the couple’s $35 million Beverly Hills mansion. But with an estate worth upwards of $275 million, Holmes is expected to seek more and there is already speculation as to how much she will collect when the papers are signed.

Sources say the 33-year-old is asking for a “suitable amount” of child support, as well as a division of property, though no mention was made of the prenuptial agreement in divorce papers.

TMZ are quoting that the famously controlling Tom Cruise, has said that he is ‘very sad’ about his wife’s decision and ‘did not see this coming’.

The office of New Jersey divorce attorney Jonathan Wolfe confirmed to the Los Angeles Times that he is representing 33-year-old Holmes in the proceedings, but declined to say whether the process had formally begun.

“This is a personal and private matter for Katie and her family,” the attorney told People magazine. “Katie’s primary concern remains, as it always has been, her daughter’s best interest.”

TMZ reports:

Katie Holmes is the one who filed for divorce and Tom Cruise was “blindsided” by Katie’s legal move … TMZ has learned.

We know Katie filed the divorce docs in New York on June 28, citing “irreconcilable differences.”  She is asking for sole legal custody and “primary residential custody” of the couple’s 6-year-old daughter, Suri.

We also know Katie is asking for a “suitable amount” of child support .. this according to the divorce docs.

Katie also asks for a division of property in her divorce docs, although we know there was a significant prenup that is based on California law.  Katie makes no mention of the prenup in her filing.

We’re also told there is some “nastiness” here, evidenced by Katie’s move to get sole legal custody.

Tom’s rep has released a statement saying, “Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children.  Please allow them their privacy to work this out.”

So what’s next for Suri Cruise, the 6-year-old fashionista with the multimillion dollar wardrobe, who is almost has famous as her celebrity parents? Leslie Gornstein from E! Online says:

I spoke to several high-powered celebrity divorce attorneys who have been following the split. If you buy some of the tabloid reports, Katie may or may not be seeking sole custody of Suri and she may have filed in New York.

If she did file in the Big Apple, that’s a very telling fact, I am told.

“It’s the public policy of New York state to recognize pre-nuptial agreements,” says Paul Talbert, partner at Chemtob Moss Forman & Talbert LLP. California, by contrast, is known for being friendlier to people hoping to fight a prenup.

Now, it’s pretty much a given that Tom and Katie’s prenup—and by all indications, there is one—likely favors the Rock of Ages actor in the cash department. So if Katie filed in NYC, she might desire something else instead, something she really thinks she can get. And that would be her daughter.

“It’s very interesting if she filed there,” Talbert tells me. “If she filed in New York, as opposed to Colorado or California, that would lead me to believe that there is a significant purpose to that filing, and my best guess is that this is where she wants to live with Suri.”

Suri reportedly attends a Scientology-influenced school in California. The logical takeaway if Katie filed in New York? She may want her daughter out of that school, too.
