Cranbrook student accused of sexually assaulting 15yo girl excused from court.

A 15-year-old boy who is accused of sexually assaulting a girl at a party while another boy filmed the incident has been excused from attending court.

The boy, who was a boarder at the exclusive Cranbrook School in Sydney’s east, is alleged to have assaulted the girl, who was also 15, at a Bellevue Hill party in March.

His case was mentioned in the Bidura Children’s court, but the boy was excused from attending as he now lives interstate.

“His parents are overseas for work and are unable to transport or accommodate him in Sydney,” a legal aid solicitor wrote.

The boy’s father is employed in a senior government role.

Victim ‘unaware’ of assault until next day

According to court documents, the alleged victim had no idea she had been sexually assaulted until the following day.

“The victim was intoxicated … and was not aware of the offence until being informed by text message the following day,” police wrote.

Police have seized video of the incident, which was shared on social media.

Another 15-year-old boy, who attended Rose Bay Secondary College, has been charged with filming the alleged assault on his mobile phone.

Both boys’ cases will return to court in May.
